What Is a Court Summons Notice Ad? β€” Legal Overview

It is a official advertisement which is done in the style of a newspaper in order that publication takes place when an averse or respondent in a civil or criminal lawsuit can not be accurately served with the summons. It is a rule subject to Order V Rule 20 of Code of Civil Procedure, 1908 and provides the defendant with legal notice of the case by way of public announcement in a newspaper.

Legal Framework β€” Laws Governing Court Summons Notice Ad

Code of Civil Procedure 1908, Order V Rule 20.

This is the main provision that deals with substituted service by newspaper. It enables a defendant through a court instructing a notification to be given in a newspaper circulating in the locality in which the defendant is at last known to have lived or conducted any business. The newspaper, which the notice was published, is specified by the court - and, like personal service, takes effect.

Order V Rule 17 & Rule 19 β€” Previous Attempts.
