What Is a Court Summons Notice Ad?

It is a official advertisement which is done in the style of a newspaper in order that publication takes place when an averse or respondent in a civil or criminal lawsuit can not be accurately served with the summons. It is a rule subject to Order V Rule 20 of Code of Civil Procedure, 1908 and provides the defendant with legal notice of the case by way of public announcement in a newspaper.

As soon as the court summons advertisement is posted and the original clipping containing affidavit is submitted in court, the notice is considered to have been served on the defendant even though the defendant did not read the newspaper. This enables the case to be conducted ex-parte in case the defendant does not show up.

Code of Civil Procedure 1908, Order V Rule 20.

This is the main provision that deals with substituted service by newspaper. It enables a defendant through a court instructing a notification to be given in a newspaper circulating in the locality in which the defendant is at last known to have lived or conducted any business. The newspaper, which the notice was published, is specified by the court - and, like personal service, takes effect.

Order V Rule 17 & Rule 19-Previous Attempts.

To order substituted service, the courts must be provided with evidence that ordinary and registered post service had been attempted. Before the court grants the publication order, the advocate has to submit an affidavit of the efforts he has made and why it failed.

Section 27, CPC — Defendant Production.

Once the court notice advertisement has been run, the summons is considered to be served. The defendant is then expected to appear in the next hearing date by the court. The non-appearance will enable the court to ex- parte the defendant.

Criminal Procedure Code (CrPC) / BNSS Criminal Summons.
