Why Government & Statutory Notices Must Be Published in Newspapers

1. General Financial Rules (GFR) β€” Rule 175 & CVC Guidelines

As per the GFR Rule 175 and Central Vigilance Commission (CVC) requirements, a tender notice should be published in at least one national English newspaper and one regional language newspaper by all the central government departments and PSUs prior to inviting bids when a set of thresholds are exceeded. Otherwise, it may cause the invalidity of the tender procedure, attract the attention of CVC and put the procuring authority under the threat of a legal lawsuit. The state governments also have similar procurement regulations where they have to publish in the newspapers.

2. SARFAESI Act 2002 β€” Sections 13(2) & 13(4)

Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act (SARFAESI Act 2002) requires the banks and NBFCs to issue the notice in two newspapers, one English and one of regional language, when giving the notice of possession as well as when conducting auctions of security assets. The fact that it was not published or is not in wide circulation by newspapers is a frequent basis by which debtors are able to have SARFAESI actions subject to challenge in the High Court. 3. RFCTLARR Act 2013 β€” Land Acquisition Notifications

According to the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013, a preliminary notification by the Collector (Section 11) must be given in the Official Gazette and two local newspapers in the locality where the land will be acquired. This informs landowners who would be affected and also allows them to make objections within 60 days. One of the greater procedural flaws that may make the whole land acquisition invalid is non-publication.

4. EIA Notification 2006 β€” Environmental Clearance Public Notices

In accordance with EIA Notification 2006 (Ministry of Environment, Forest and Climate Change), the applicant/project proponent who intends to receive an environmental clearance should place an advertisement in at least one English and one regional language daily newspaper at least 30 days prior to the actual meeting. This calls in the comments by the people on the environmental impact assessment.
